The items of intellectual property to be registered in Eurasia are inventions only.

 

A Eurasian patent is a uniform regional patent, which verifies exclusive rights for an invention on the territory of states that participate in the Eurasian Patent Convention (EAPC). Those countries include

 

Turkmenistan

Belarus

Tajikistan

Russian Federation

Kazakhstan

Azerbaijan

Armenia

Kyrgyzstan

 

The Eurasian patent system’s invention registration procedure has certain features, and our work in connection herewith includes the following main stages

 

1. We reveal the technical solution, which looks the most viable to be patented as an invention. It is the most common, when you approach us with a ready solution, yet there are more complicated situations, when in a plurality of ideas a specific idea is to be found, the one, which would be successfully approved and finalized as a Eurasian patent.

2. Patent information search to reveal technical solutions, which may be selected as analogs and the prototype for your solution. In addition, based on such search, it is the analysis of the materials found that help with making a preliminary judgment on your solution potential patentability.

3. We formulate the claims of the invention, together with its description and abstract, all in accordance with the corresponding requirements by Eurasian Patent Organization. You certainly see the prepared documents before the documents are to be filed with the Patent office, thus any correction, should it be needed before your approval, will be uncomplicated.

4. We prepare the set of documents for filing the application for registration, we proceed with paying corresponding fees, and we actually file the application for registration with the Eurasian Patent Organization. The application is filed in the Russian language, which is the official language of the Eurasian Patent Organization, unlike the European Patent Office with its three official languages (English, German and French).

5. Following next is the application examination. The Examiners from the Eurasian Patent Organization verify the application materials for meeting the requirements as set forth by the Eurasian Patent Organization, and also the technical solution is examined substantively for meeting patentability criteria. The Eurasian substantive examination is essentially similar to the same in the Russian patent office, but some differences do exist.

6. We make all the necessary correspondence with Examiners of the Patent office, including filing additional materials, requests, responses for Office actions. For example, should an Examiner from the Patent office have doubts, the Examiner addresses the applicant with a corresponding Office action. Together with you, we formulate a legitimate response for such Office action.

7. After the positive resolution is issued, we finalize the procedure in connection with the invention registration and receive the Patent.

8. To keep the Patent valid, corresponding annual patent fees must be duly paid. Particular countries may be selected, where the Patent is to be maintained valid.

 

Additional information:

 

• Filing an application with the Eurasian Patent Organization does not require specifying participating countries, thus, no payment is required for such specifying;

• Providing translations to national languages of the participating countries is not required, even if the patent should be granted in particular specified countries;

• It is not required to additionally pay annual fees for maintaining the application valid as the application is being processed;

• After the patent is granted, subsequent annual fees to keep the Eurasian patent valid are paid to the Eurasian Patent Office rather than to Patent offices of individual participating countries.

 

With no requests for additional actions by the applicant from the Examiner, the examination takes 8 – 12 months, during which notifications and other documents may arrive, which you will be notified about.

 

After the examination positive resolution granting the Eurasian patent, you pay the corresponding fee and obtain the patent within 3-5 months.
